EXTENSION OF MEASURES TO MITIGATE IMPACT OF THE GLOBAL FINANCIAL CRISIS
ON THE CONSTRUCTION INDUSTRY FOR PUBLIC SECTOR CONSTRUCTION PROJECTS
 
1. In Dec 2008, the Building and Construction Authority has worked with the Ministry of Finance to implement     measures to mitigate the impact of global financial crisis on the construction industry undertaking public     sector construction projects.

2. While there are signs of the economy recovering, it is noted that the construction industry typically lags behind     other economic sectors when it comes to recovery. Therefore, the Government has decided that the following     temporary measures be extended till 30 Jun 2010:

a) More frequent, prompt and full payment for work done
    To facilitate the cash-flow of contractors and consultants, government agencies will continue to make more     frequent payments (e.g. twice a month) to contractors and consultants for work done as well as to expedite     the evaluation and payment settlement of variation orders after assessing their impact on the final contract     value.

b) Lowering the quanta of security deposits
    To alleviate contractors' constraint on working capital, the quanta of security deposits for public sector     projects have been reduced. For construction projects with value of up to $15 million, the quanta of security     deposits shall be capped at 1.25% of the project value. For construction projects with value exceeding
    $15 million, the security deposits shall be capped at 2.5%. However, for special circumstances, government     agencies could also consider increasing the quanta to a maximum of 10%.

MEASURES TO FURTHER EASE CASH FLOW FOR THE CONSTRUCTION INDUSTRY ON PUBLIC SECTOR CONSTRUCTION PROJECTS
 
1. The Building and Construction Authority has worked with the Ministry of Finance to implement the following     measures to further assist the construction industry undertaking public sector construction projects. However,     for special circumstances, government agencies could exercise their discretion.

a) Early Release of Retention Sum
    Government agencies are discouraged to collect retention sum unless circumstances warrant it. Government     agencies are also advised to favourably consider the request of contracting party (i.e. contractor, consultant,     supplier or others) for an early release of such sum, if a bond of the same amount can be provided by the     contracting party. In addition, where government agencies have assessed and agreed to release the retention     sum, no interest or other administration fees arising from the early release of retention sum should be imposed     or collected from the contracting party on the retention sum being released.

b) Revised Payment Schedule for Construction Consultancy Services
    There are items of services of the milestone payment for consultants linked to the occurrence of events which     are not within the consultants' control (i.e. rectifying of all defects and handing over to employer's maintenance     agency). Such events have been removed from the milestone payment. Government agencies are also     encouraged to add the issuance of Certificate of Statutory Completion (CSC) as a new item for milestone     payment. For projects whereby CSC is not applicable, government agencies are encouraged to make the     payment upon the issuance of the Final Completion Certificate or equivalent.

c) Waiver on Imposition of Security Deposits (SDs) and Liquidated Damages (LDs) on Consultants for     Construction Works
    To align public sector practice with industry norms, government agencies are advised not to impose SDs and     LDs on consultants of all disciplines listed under the Public Sector Panel of Consultants for construction     consultancy tender.

FIRST-LEVEL SUB-CONTRACTING
 
All government construction and construction-related works will require all first level sub-contractors to be registered with BCA for main construction contract tenders called from Jun 09 onwards. As for first level suppliers and service-providers such as supply of office equipment and computers, canteen operators, rental of vehicles/cranes, security, furniture, storage systems and cleaning services, the suppliers and service-providers, who are not registered with BCA, must then be registered with EPPU (Expenditure and Procurement Policies Unit) which is administered by MOF.

CHANGES TO CW AND CR WORKHEADS
 
Due to the implementation of General Builder Licence (BLS) on 16 December 2008 and to address our regulatory head RW01 (Window Contractors), there is a need to revise the Construction (CW) and Construction-Related (CR) workheads and their requirements. The following changes will take effect on 17 June 2009

CR08 (Piling) will be renamed as CR08 (Piling Works). This workhead will require Specialist Builder SB(PW) licence.

CR10 (Precast Concrete Products) will be renamed as CR10 (Pre-cast Concrete Works). This workhead will require Specialist Builder SB(PC) licence.

CR12 (Site Investigation & Ground Stabilization) will be split into two workheads:

     i) CR12 (Ground Support and Stabilisation Works) with no change in financial grades. This workhead         will require Specialist Builder SB(GS) licence.

    ii) Newly created CR15 ( Site Investigation Works) with no financial grades. This workhead will require         Specialist Builder SB(SI) licence.

CR16 (Curtain Walls, Windows & Doors) will be split into three workheads:

    i) CR16 (Curtain walls) which will cover supply & installation of curtain walls.

    ii) Newly created CR17 ( Windows) with no financial grades. This workhead will require RW01 as
        per-requisite.

    iii) Newly created CR18 (Doors) with no financial grades.

CW01 (General Building) and CW02 (Civil Engineering) will require General Builder Class 1 licence (GB1) for financial grades A1 - B2 and General Builder Class 2 licence (GB2) for financial grades C1 to C3.

c)    Extending the period to provide security deposits and flexibility in obtaining security deposits from any
       MAS-approved banks or MAS-approved insurance companies
       The Public Sector Standard Conditions of Contract (PSSCOC) has been amended to allow government        agencies, if deemed necessary, to stipulate a period longer than 14 days for contractors to provide security        deposit. Previously, the insurance company needs to be approved by the Employer. The PSSCOC now        provides contractors more flexibility and choices in obtaining security deposits as long as they are from any        MAS-approved banks or MAS-approved insurance companies.

2.    Measures (a) and (b) are temporary measures which will be reviewed in Dec 2009.

MANDATORY EMAIL ADDRESS FOR BCA REGISTERED CONTRACTORS
 
The BCA Contractors Registration System (CRS) will be gradually moving towards a full electronic platform. For a start, all future circulars or updates will be disseminated through emails. As such, all BCA registered contractors (including new applicants) are required to have a valid email address.

TENDERING LIMIT VARIABLE COMPONENT (TLVC)
 
The Tender Price Index (TPI) is published by BCA every quarterly with data taken from actual tender prices. It reflects the recent trend in construction cost due to changes in prices of materials, manpower, plants & machinery, and overheads and profits. Over the years the TPI has moved up significantly. The Tendering Limit Variable Component (TLVC) is determined using the Tender Price Index (TPI) to reflect the impact of tender price movements on project value. BCA will adjust the tendering limits once a year on the first of July.
